Welcome to Nearby Spaces! These Terms of Service (“Terms”) govern your access to and use of the Nearby Spaces platform (“Platform”), operated by Nearby Inc., a U.S.-based corporation (“Nearby,” “we,” “us,” or “our”). By accessing or using the Platform, you agree to comply with and be legally bound by these Terms. If you do not agree, you may not use the Platform.
You must be at least 18 years old and capable of entering into legally binding contracts to use Nearby Spaces. You are solely responsible for complying with all applicable laws and regulations in your jurisdiction, including property, zoning, and tax laws.
Nearby provides a technology platform for Hosts and Renters to connect. Nearby is not a property manager, insurer, or broker, and does not own or control the listed Spaces. Nearby may facilitate payments and dispute resolution but is not a party to agreements between Hosts and Renters.
You agree to provide accurate information when creating your account. You are
responsible for safeguarding your login credentials. You agree not to register multiple
accounts or impersonate any person or entity.
All transactions between Hosts and Renters must be completed on the Platform. Hosts set their own pricing. Nearby charges service and processing fees as displayed during checkout. Recurring billing applies for monthly bookings. By booking a Space, you authorize Nearby to charge your selected payment method. Nearby may withhold Host payouts for policy violations or pending investigations.
Nearby offers optional insurance and/or protection plans for Hosts and Renters. Coverage details, limits, and exclusions are described in the applicable policy documents. Coverage may be underwritten by a third-party insurer. Neither Nearby nor its insurance partners cover prohibited items or items stored in violation of these Terms.
Renters may only use Spaces for lawful storage or parking purposes. The following items are strictly prohibited:
Nearby and Hosts reserve the right to inspect and/or remove items stored in breach of these rules in compliance with applicable law.
Cancellation policies for Renters and Hosts are disclosed at the time of Booking. Refunds are subject to the cancellation window and reason. Nearby reserves the right to issue partial or full refunds at its sole discretion.
Nearby complies with the General Data Protection Regulation (GDPR) for users in the EU. By using the Platform, you consent to our collection, use, and transfer of personal data as described in our [Privacy Policy]. You may request access or deletion of your data by contacting privacy@nearbyspaces.com.
Nearby encourages amicable resolution between Hosts and Renters. In unresolved
disputes, either party may contact Nearby for mediation. If unresolved, disputes shall be governed by the laws of the State of Delaware, USA, unless otherwise required by the laws of Romania or the European Union.
To the maximum extent permitted by law, Nearby shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid by you through the Platform in the 12 months preceding the claim.
Nearby may suspend or terminate access to the Platform at any time for violation of these Terms or applicable laws. You may cancel your account at any time. Termination does not release either party from obligations incurred before termination.
Nearby may update these Terms from time to time. We will notify users of significant
changes via email or through the Platform. Continued use of the Platform after changes are made constitutes acceptance of the revised Terms.

These Terms of Service are governed by U.S. and EU consumer law. Hosts operating in Romania are additionally bound by Romanian Civil Code requirements for rentals and service contracts.
